Client Terms and Conditions

Welcome to Owambe Connect ("Owambe Connect", "we", "our" or "us").

These Terms and Conditions govern your use of the Owambe Connect website, mobile applications (where applicable) and related services. By creating an account or using our platform, you confirm that you have read, understood and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Owambe Connect.

1. About Owambe Connect

Owambe Connect is a UK-based online platform designed to help individuals discover trusted vendors for culturally rich celebrations.

Our platform enables clients to:

• search for vendors;
• compare vendor profiles;
• save favourite businesses;
• contact vendors directly;
• access planning tools where available.

Owambe Connect is not an event planner, booking agency, employer, payment processor or party to any agreement between clients and vendors.

2. Eligibility

To register as a client you must:

• be at least 18 years old;
• provide accurate and complete registration information;
• keep your account details up to date;
• have the legal capacity to enter into agreements.

By registering an account, you confirm that the information you provide is truthful and accurate.

3. Client Accounts

You are responsible for:

• maintaining the confidentiality of your password;
• all activities carried out using your account;
• ensuring your contact information remains current.

You agree to participate in the KYC user registration process and undertake to furnish us with accurate, up to date and valid documents requested of you.

You further undertake to keep your password confidential and take responsibility for the use of your account and password. You must notify us immediately if you believe your account has been accessed or compromised without your permission.

We reserve the right to suspend or terminate accounts containing false, misleading or fraudulent information or if the information/document supplied to us during the KYC user registration process is false or invalid..

4. Acceptable Use

You agree to use Owambe Connect lawfully and respectfully.

You must not:

• impersonate another individual or business;
• submit false enquiries;
• misuse vendor contact information;
• send spam or unsolicited marketing;
• upload malicious software;
• interfere with website security;
• scrape or copy platform content;
• harass vendors or other users;
• publish unlawful, offensive or defamatory material.

Failure to comply may result in suspension or permanent removal of your account.

5. Using Owambe Connect

Owambe Connect is intended solely to assist clients in discovering vendors.

You may:

• browse vendor profiles;
• compare businesses;
• save favourites;
• contact vendors directly;
• use planning features provided by the platform.

You may not use Owambe Connect for unlawful or commercial activities unrelated to planning celebrations.

6. Vendor Listings

Vendor profiles are created using information supplied by the vendors.

Although we take reasonable steps to maintain the quality of our platform, we cannot guarantee that every listing will always be:

• accurate;
• complete;
• current;
• available.

Clients should always carry out their own enquiries before engaging any vendor.

7. Vendor Verification

Some vendors may display verification indicators.

Verification confirms only that the vendor has satisfied Owambe Connect's verification requirements.

Verification does not guarantee:

• service quality;
• reliability;
• professionalism;
• future performance;
• availability;
• suitability for your event.

Clients remain responsible for making their own informed decisions.

8. Vendor Availability

A vendor appearing on Owambe Connect does not mean they are available for your chosen event date.

Clients must contact vendors directly to confirm:

• availability;
• pricing;
• services offered;
• booking terms;
• delivery times.

9. Independent Vendors

All vendors listed on Owambe Connect operate as independent businesses.

Nothing on the platform creates:

• an employment relationship;
• an agency;
• a partnership;
• a joint venture.

Each vendor is solely responsible for the services they provide.

10. Bookings and Contracts

All bookings are made directly between clients and vendors.

Owambe Connect does not:

• negotiate contracts;
• prepare agreements;
• guarantee bookings;
• guarantee vendor availability;
• supervise services;
• oversee event delivery.

Any contract entered into is solely between the client and the vendor.

11. Payments

Unless expressly stated otherwise:

• payments are made directly to vendors;
• Owambe Connect does not collect client payments;
• we do not hold deposits;
• we are not responsible for refunds;
• we are not responsible for payment disputes.

Clients should satisfy themselves before making any payment.

12. Communication

All communication between clients and vendors takes place directly.

We are not responsible for:

• response times;
• quotations;
• negotiations;
• missed communications;
• contractual discussions.

13. Reviews and Ratings

Where reviews are available, clients agree that reviews will:

• reflect genuine experiences;
• be truthful;
• be respectful;
• not contain offensive or defamatory content.

We reserve the right to remove reviews that breach these Terms or applicable law.

14. Saved Vendors and Favourites

Saving a vendor or adding them to your favourites:

• does not create a booking;
• does not notify the vendor;
• does not reserve availability.

These features are provided solely for your convenience.

15. Planning Tools

Planning tools made available by Owambe Connect may include:

• guest lists;
• checklists;
• budgets;
• event websites;
• gift registries;
• RSVP management.

These tools are intended to assist planning only.

Clients remain solely responsible for organising and managing their events.

16. Gift Registry

Where gift registry services are provided:

• purchases may occur through third-party retailers;
• pricing and availability are controlled by those retailers;
• external purchases are governed by the retailer's own terms.

Owambe Connect accepts no responsibility for products supplied by third parties.

17. User-Generated Content

If you upload reviews, comments, photographs or other content, you confirm that:

• you own the content or have permission to share it;
• you have firsthand experience of the subject matter for which your review is requested;
• have not organised a campaign encouraging others to post reviews, whether positive or negative;
• it does not infringe another person's rights;
• it is lawful;
• it is accurate;
• it is not rude, offensive, misleading or defamatory.

You grant Owambe Connect a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and publish such content for the purpose of operating, promoting and improving the platform.

We reserve the right to remove any content that breaches these Terms.

We exclude any liability for any review or for any claims, liabilities, or losses arising from any review.

18. Intellectual Property

All intellectual property belonging to Owambe Connect, including:

• branding;
• logos;
• graphics;
• software;
• text;
• design;
• website content;

remains the property of Owambe Connect or its licensors.

No content may be copied, reproduced, sold, distributed or exploited for any commercial purpose without written permission.

19. Third-Party Websites

Our platform may contain links to third-party websites.

We are not responsible for:

• third-party content;
• products;
• services;
• privacy practices;
• website security.

Use of third-party websites is at your own risk.

Incorporation of, linking to, any third-party websites or content does not imply our approval or endorsement by us. Any access to, use or visit to them is at your own risk, and you should be aware these Terms do not govern them.

We exclude any liability for loss that you may suffer as a result of the content and activities of these linked third-party websites.

20. Platform Availability

We aim to provide continuous access to Owambe Connect.

However, we cannot guarantee uninterrupted availability.

21. Fraud Prevention

23. No Warranty

• booking outcomes;
• accuracy of listings.

24. Limitation of Liability

To the fullest extent permitted by law, Owambe Connect shall not be liable for:

• disputes between clients and vendors;
• cancelled bookings;
• financial losses;
• event failures;
• poor workmanship;
• delays;
• missed deadlines;
• personal injury arising from vendor services;
• indirect or consequential losses.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

Notwithstanding any provision to the contrary, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to your monthly subscription amount during the period before any cause of action arising.

25. Indemnity

You agree to indemnify and hold harmless Owambe Connect, its directors, employees and affiliates from any claims, liabilities, losses, damages, costs or expenses arising from:

• your misuse of the platform;
• your breach of these Terms;
• disputes with vendors;
• your breach of applicable law.

26. Reporting Concerns

Clients may report concerns regarding vendors through our reporting process.

Although we may investigate breaches of our platform policies, Owambe Connect is not responsible for resolving private contractual disputes between clients and vendors.

27. Account Suspension

We reserve the right to suspend or permanently terminate accounts where users:

• breach these Terms;
• misuse the platform;
• engage in fraudulent activity;
• provide false information;
• use the platform unlawfully.

28. Privacy

We process personal information in accordance with our Privacy Policy.

By using Owambe Connect, you consent to such processing.

29. Force Majeure

Owambe Connect shall not be liable for delays or failures caused by events beyond our reasonable control, including:
